At the January 25, 2012 Planning Commission hearing, the Commission voted 4-3 to continue the hearing and direct staff to return to the Commission on Wednesday February 8, 2012 with findings to recommend the City Council deny the entirety of the Crown Castle project. Findings for denial will be presented to the Commission for formal adoption at the February 8 hearing. The hearing will be held in the Community Chambers, 23 Russell Boulevard, at 7:00 p.m.

The Crown Castle proposal will also go before the City Council for review and action. The City Council hearing will be scheduled for March, 2012. Public Hearing Notices will be distributed and posted to this site once a specific City Council hearing date is identified.

Supplemental Information submitted by the applicant in response to Planning Commission comments. The continued Planning Commission hearing is tentatively scheduled for 01/25/12. Additional noticing and updates will be provided prior to the hearing.

Modifications were made to the example demonstration poles to show the proposed design alternatives.

The City is awaiting submittal of additional documents from the applicant. Upon submittal of the materials and staff review, the project will be rescheduled for a continued Planning Commission hearing. Please check back for updates. The project will be re-noticed prior to the hearing.

Rescheduled Planning Commission Hearing

The September 28, 2011 Planning Commission has been cancelled. The public hearing on the project has been rescheduled to October 12, 2011.

Please note that the project will NOT be heard by the Planning Commission on September 14, 2011. At the applicant’s request, the project was rescheduled and continued to the September 28, 2011 meeting date.

Continued Planning Commission Hearing

The Planning Commission held a public hearing and continued the item to September 14, 2011 and directed the applicant to evaluate alternative locations and/or designs for 14 of the 25 sites. The 14 sites consist of Sites #2, #4, #8, #9, #11, #12, #13, #15, #16, #18, #19, #21, #23 and #24. As more information becomes available, it will be posted to this site.

What Jurisdiction Does the City Have Over Telecommunications Facilities?

Local actions over telecommunication facilities are subject to Section 332(c)(7) of the Federal Communications Act (http://wireless.fcc.gov/siting/local-state-gov.html) which limits the authority of local agencies to regulate the siting of communication facilities. It prohibits local agencies from discriminating on the basis of alternate technologies and preempts local agencies from regulating RF health effects assuming the provider complies with FCC RF rules. The City does have the authority to regulate the time, place, and manner of facilities (e.g. aesthetics).

Installation of three demonstration poles with mock antennas as part of the City’s review process to demonstrate what a typical facility would look like.

Note: Due to complications at the site, installation of the demonstration pole located at 8th Street and J Street (Site #24) is not expected to be completed until Monday August 9th. The other two demonstration poles (Sites #5 and #22) are installed and may be viewed.

Previously, New Path Networks began construction on antennas for cellular phone service throughout Davis and El Macero. The construction was proposed to include areas with new poles, as well as antennas on existing light standards. On Monday November 30, 2009 City Manager Bill Emlen issued a “Stop Work” order for all construction on the project, effective immediately. The purpose of the Stop Work order was to provide time for the City to investigate potential conflicts with the City’s Telecommunications Ordinance. The City Manager has committed to striving to work expeditiously during this review. Additional information will be posted on this site as it is received.
