Bretton Woods TM Conditions Amendment Request

In June 2022, the applicant submitted an application requesting several amendment to the approved conditions of the Bretton Woods small lot tentative map, which was approved by the Planning Commission on September 23, 2020 (Bretton Woods PC Staff Report (9/23/2020)) with approval of a subsequent clarification to the conditions on November 4, 2020 (Bretton Woods PC Staff Report - Condition of Approval Language Clarification (11/04/2020)).

November 15, 2022 the City Council heard an appeal of the Planning Commission's action on the request and upheld the Planning Commission's action, with the exception of allowing the material change from concrete to asphalt for the internal greenway paths and the addition of the requirement addressing the regular maintenance of the asphalt paths by the HOA. None of the other requested changes were approved relative to ownership and maintenance of the Cottages streets or any reduction in the width of the multi-use paths.

The City Council’s action included approval of the following change:

 

  • Improvement Plans – Condition #30(D)(7).

    Multi use Paths shall be constructed as follows:

    1. Ag Buffer: 12 foot wide concrete path with 2 foot wide decomposed granite shoulders.
    2. Greenways: 10 foot wide path constructed of concrete asphalt with no shoulders.
    3. Walking paths not built with asphalt or concrete shall be decomposed granite.

       

      And addition of the following requirement as presented to City Council with the clarification for inclusion in the CC&R’s and review by the City Attorney:

       

  • The developer shall include as part of the Homeowner’s Association (HOA) responsibility the regular maintenance and schedule of the asphalt pathways. The following language shall be incorporated in the CC&R’s, which is subject to review and approval of the City Attorney: “Association shall apply slurry seal to asphalt pathways and repair any cracks or lifts no less than every five years unless a longer duration is authorized in writing by the City.”

 

The City Council otherwise upheld the following October 12, 2022 Planning Commission action on the project:

 

  1. Accept the recommendations of the Open Space and Habitat Commission to amend COA #6.A.5 and 30.C.8, as follows:

     

    Condition of Approval 6.A.5

    The culvert used to cross the Covell Boulevard drainage channel to create Spirit Street shall be a wildlife connectivity culvert, sufficient in design capacity to convey drainage; include a natural creek bottom; and include one or more ledges to allow for below grade passage of various species. The final design and size of the ledges shall be to the satisfaction of the City’s Wildlife Resource Specialist Biologist.

     

    Condition of Approval 30.C.8

    A crossing shall be constructed across the northern drainage channel, at the edge of the eastern detention basin, to provide a physical connection between the project and the northern side of the drainage channel. The crossing shall include a box culvert(s). This crossing shall include a wildlife-friendly gap in the fence around the expanded eastern detention basin as the wildlife connectivity element, and the final design of this element shall be reviewed and approved by the City’s Wildlife Resource Specialist. similar to the box culverts on Covell Boulevard which include natural bottom and ledges for wildlife crossings. The final design of this vehicular crossing shall be approved by the City Engineer.

     

  2. Reject all other requested changes to the approved conditions of approval.
