Work in the Right of Way
Encroachment Permits
An encroachment permit is required for any construction, repair, or maintenance of pipes, cables, conduits, etc. located within the public right-of-way (ROW). Examples:
- Sewer reconnection
- Water connection
- Sidewalk replacement
- Street cut
- Trench Cut Fees
Please note that prior to an encroachment permit issuance, improvement plan approved, or work performed causes an excavation of a paved city street, the applicant shall pay a trench restoration fee.
In addition, an encroachment permit is required when equipment needs to cross or be placed in the ROW during construction on private property. Examples:
- Equipment crossing a sidewalk during pool construction
- Vehicles using a bike path to access a property
- Construction dumpster or portable toilet placed on a street adjacent to a construction site
Other cases requiring permitting:
- Construction water/hydrant meter/water use
- Transportation Permit / Oversize Load
Durable Encroachment Permits
A durable encroachment permit is needed for any permanent fixture owned by a private company that is within the public right-of-way. Examples:
- Outdoor seating for restaurants
- Sculptures
- Private communication lines
Trench Cut Fees
Trench cut fees will be applied to a permit any time construction in the street requires a cut in the pavement. Please see the flyer for more information.
